Understanding Closing Costs in New Mexico: Who Pays What?

Whether you are buying a golf course home in Las Cruces or a historic property near the university in Silver City, the closing table can bring some financial surprises if you aren't prepared.

Closing costs are the collection of fees, taxes, and administrative charges required to legally transfer a property. While everything in real estate is technically negotiable, below is a brief guide to how closing costs are typically split between the Buyer and the Seller.

Here is exactly who pays what in a typical 2026 transaction.

The Buyer's Side (Typically 2% to 5% of Purchase Price)

For buyers, closing costs are largely driven by the mortgage lender. If you are paying cash, your closing costs will be significantly lower.

When financing a home, buyers are usually responsible for:

  • Loan Origination Fees: This is what your lender charges to process and underwrite your mortgage (usually 0.5% to 1% of the loan amount).

  • Appraisal & Inspections: You pay third-party professionals to assess the home's value (usually $600+) and its physical condition ($350+).

  • Pre-Paids & Escrow Setup: Your lender will require you to pay a few months of property taxes and the first year of homeowners insurance plus a few months upfront to fund your escrow account.

  • Buyer Brokerage Compensation: Depending on your representation agreement and what concessions the seller offers, you may be responsible for compensating your Buyer's Broker.

  • Lender’s Title Insurance: This policy protects the bank’s investment in the property.

The Seller's Side (Typically 6% to 8% of Sale Price)

Sellers generally carry a larger percentage of the closing costs in New Mexico, primarily because they cover the professional fees associated with marketing the home and ensuring the title is clear.

Sellers are usually responsible for:

  • Brokerage Compensation: Real estate brokerage compensation is, and always has been, fully negotiable. Sellers negotiate brokerage compensation with the listing brokerage and sometimes will cover part or all of the Buyer's Brokerage compensation.

  • Gross Receipts Tax (GRT): This is uniquely New Mexico! The state charges a tax on services rendered, which typically applies to the brokerage compensation. However, remember that every cost is negotiable, and there are exceptions (such as on foreclosed properties) where some sellers do not pay GRT.

  • Owner’s Title Insurance: In New Mexico, it is highly customary for the seller to purchase the Owner’s Title Policy for the buyer, guaranteeing the home is free of hidden liens or legal claims.

  • Prorated Property Taxes: Sellers pay the property taxes for the exact number of days they owned the home during the current calendar year.

Can Buyers Ask Sellers to Pay Their Closing Costs?

Yes. This is called asking for Seller Concessions.

In our current balanced market, it is becoming more common for buyers to request that the seller cover a portion of their closing costs. This strategy allows buyers to keep more cash in their pockets for moving expenses or immediate renovations, while still securing the property. However, strong negotiation is required to structure an offer that remains attractive to the seller.

Because we hold the title of Broker, we carry a higher level of direct legal responsibility and are held to strict statutory duties under the New Mexico Real Estate Commission. The Rules Have Changed (For the Better)

If you haven't bought a home in a few years—or if you are moving here from a state like Texas or California—you might find the New Mexico process a little surprising.

In 2026, buying a home in Las Cruces is more transparent than ever, but it requires a strategic approach. Whether you are eyeing a new build in Metro Verde or a historic adobe in Mesilla, following these six steps will save you time, money, and stress.

Step 1: The "Local" Pre-Qualification

Before we look at a single house, you need a "Proof of Funds" or Pre-Qualification letter. Pro-Tip: In the Las Cruces market, listing brokers prefer local lenders over big-box national banks. A letter from a trusted local lender tells the seller, "This deal will actually close."

  • Action Item: Don't know who to contact? Send me an email for a list of local loan officers.

Step 2: Sign the Buyer Broker Agreement

Since the industry shifts of 2024, this is now a standard requirement before touring homes.

  • What it is: A simple agreement that hires me to represent you, not the seller.

  • Why it matters: It clarifies exactly how I get paid (often by the seller, but fully transparent to you) and legally binds me to fight for your best interests during negotiations.

  • The 2026 Standard: For the vast majority of homes on the market, a broker cannot unlock a door without this document in place.

    • The Exception: If you want to view a home listed directly by Saenz & Smith Real Estate Co., any of our brokers can host a showing without this agreement upfront. However, if you decide to write an offer, a Buyer Broker Agreement must be signed before we can proceed.

Step 3: The Search (Quality Over Quantity)

This is the fun part! But in 2026, we don't just "go look at houses." We look at data.

  • Check the Inventory: As we discussed in our Market Update, inventory is sitting at a healthy 4.8 months. This means you don't have to rush.

  • The "Drive-By" Rule: Before we schedule a viewing, drive by the neighborhood in the morning, afternoon, and evening. Do you like the activity level? Is the commute realistic?

Step 4: Making the Offer & The "Due Diligence" Period

Once we find "The One," we write an offer. In New Mexico, our contracts are very buyer-friendly.

  • Earnest Money: Usually 1% of the purchase price, deposited within 48 hours.

  • Objections & Inspections: You typically have a 10–14 day period to inspect everything. This is your "get out of jail free" card. If the roof is bad or the HVAC is ancient, we can ask for repairs, a price reduction, or simply walk away with your earnest money intact.

Step 5: The "Dry Closing" (Crucial for Relocations!)

This is the #1 surprise for out-of-state buyers. New Mexico is a "Dry Funding State."

  • What this means: When you sign the papers at the title company, you do not get the keys immediately.

  • The Timeline: Keys are released only after the deed is recorded with Doña Ana County and funds are in the custody of the title company. This usually happens 24 to 48 hours after you sign.

  • Planning Tip: Do not schedule your moving truck to arrive in the driveway an hour after signing! Plan for a 1-day buffer.

Step 6: Welcome Home
